Tax debt guide

Past due returns: build a filing plan one year at a time

Create a clear inventory of missing returns and records before discussing filing compliance and tax debt options.

When more than one return is missing, an organized inventory makes the problem easier to evaluate. Identify the years, the available records, and any active notice before setting a filing sequence.

Confirm the filing gap

Create a list of years you believe are missing, then verify it through records and the appropriate IRS account information. Include copies of any notice that identifies a required return. Filing requirements depend on the facts; do not assume that every empty year has the same obligation.

The IRS says past due returns should be filed even when you cannot pay in full. If a notice directs you to a particular location, follow the notice instructions. IRS past due returns guidance ↗

Prepare each year as its own file

  • Income documents for that year.
  • Business records and relevant supporting receipts.
  • Prior-year information that may carry forward.
  • Payments and withholding for the same year.
  • Notices or substitute-return correspondence.

Label corrected documents clearly. Keep unresolved questions next to the supporting record instead of forcing an estimate into the file. A preparer can then see what needs to be verified before a return is signed.

For joint returns, discuss who needs to provide information and sign. If household circumstances changed, identify that change without assuming the prior year’s filing choices automatically carry forward.

Connect filing work with balance review

After a return is prepared, confirm how filing and acceptance will be tracked and when the resulting account should be checked. A return showing an amount due is not the same as a verified account history for every year.

Ask Republic Tax whether a tax relief engagement includes preparation of past due returns, filing follow-up, and investigation of any substitute return. Fees and responsibilities should be clear before you agree.

Keep current-year filing work on the calendar while addressing the backlog. An orderly plan should say what happens first, what is waiting for documents, and how you will confirm each completed step.

Three questions to take with you

  • Which returns are actually required and missing?
  • Who prepares, files, and confirms each return?
  • When will we reconcile the updated balances?
